Call for Papers for the AIDA Europe Conference in Zurich
(October 22-23, 2009)
The AIDA Europe Student/Academic Sub-Committee invites students and young practitioners to participate at the 2nd AIDA Europe Conference to be held in Zurich on 22-23/10/2009.
The selected papers will be presented at the relevant Working Party sessions.
The Working parties meeting in Zurich at the 2nd AIDA Europe Conference and the topics designated are as follows:
Marine Insurance Working Party
1. Maritime Insurance & Piracy
Reinsurance Working Party
1.Back to back cover and incorporation of terms
2. Reinsurers' liability for the reinsured's defence costs and for awards of exemplary damages against the reinsured
3. Insurable interest in reinsurance.
Consumer Protection and Dispute resolution Working Party
1.Does insurance contract law (or insurance market) need a specific protection for "consumer" ?
2. In case of dispute between the insured and the insurer, can the mediation be compulsory?
3. Which is the best sanction in case of a lack of the legal information which has to be delivered to the policyholder?
Life insurance, Pensions and Collective Insurance Working Party
1. Choice of law in life insurance contracts
2. The prevelance/relation of insurance contract law over /with general contract law and principles. Discuss and elaborate with examples
3. Group insurance and colletive insurance based on collective agreements
Liability Insurance Working Group
1. Sources of liability covered under the policy: i) tort and contractual liability ( especially professional and medical liability) ii) Liability based upon fault or negligence, and strict liability.
2. In general, and for the purposes of Insurance Law, from which moment liability exists?
Working Party on the Distribution of Insurance Products
1. State supervision issues; concentration of supervisory authorities: one Regulator competent for monitoring all financial activities versus division of competence between insurance, financial and bank supervisory bodies - benefits and pitfalls of each system.
2. Conflict of interest: banks obligation to provide their customer with a financial advice that best suits their needs versus bank’s obligation to promote insurance products.
3. Civil liability of insurance intermediaries: issues on causal relation between error or omission of the intermediary and the damage suffered by his client.
Those interested should submit a 2 pages abstract and outline of the paper to be considered for presentation at the conference to the attention of the AIDA Europe Student/Academic Sub-Committee (Dr Kyriaki Noussia, noussia@gmail.com, Prof. Dr. Robert Koch, Robert.Koch@jura.uni-hamburg.de) by 1st June 2009. Selection will be concluded in late June 2009. The successful candidate(s) will then have to submit the full text of the paper to the AIDA Europe Student/Academic Sub-Committee by 21st September 2009. Travel expenses and conference fee will be covered.
